1. Purpose

These Terms of Service (hereinafter "Terms") govern the use of the Marravel mobile application and the website marravel.com (hereinafter "the Service"), published by Ederest (formerly UP2CAREER), a Moroccan SARL with a share capital of 100,000 MAD, registered under RC 638733, ICE 003546325000059.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

Marravel is a mobile application offering gamified walking tours in Marrakech, Morocco. The Service includes:

Self-guided and gamified tours with GPS navigation
QR code challenges and cultural quests
Point collection and achievement systems
Tour booking and scheduling
In-app purchases for premium tours

3. Account Registration

To use certain features of the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 16 years old to create an account. If you are under 18, you must have parental or guardian consent.

4. Tours and Bookings

4.1 Free Tours

Certain tours are available for free. Ederest reserves the right to modify, suspend, or discontinue free tours at any time without prior notice.

4.2 Paid Tours

Premium tours require payment. All prices are displayed in Moroccan Dirhams (MAD) and include applicable taxes. Payment is processed through Payzone, our authorized payment provider.

4.3 Cancellation and Refunds

You may cancel a booked tour up to 24 hours before the scheduled start time for a full refund. Cancellations made less than 24 hours before the start time are non-refundable. Refunds are processed within 7 business days to the original payment method.

5. User Conduct

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, decompile, or disassemble the application
Interfere with or disrupt the Service or its servers
Create multiple accounts for fraudulent purposes
Share, sell, or transfer your account to third parties
Use automated systems (bots, scrapers) to access the Service

6. Safety During Tours

While participating in tours, you are responsible for your own safety. You should:

Be aware of your surroundings at all times
Follow local laws and regulations
Not use the application while driving or in dangerous situations
Stay hydrated and take breaks as needed, especially in hot weather

Ederest is not responsible for any injury, loss, or damage that may occur during a tour.

7. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, icons, images, audio, software, and tour content) are owned by Ederest and are protected by Moroccan and international copyright, trademark, and other intellectual property laws.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

9. Limitation of Liability

To the maximum extent permitted by law, Ederest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.

10. Modifications

Ederest reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Termination

Ederest may suspend or terminate your account at any time for violation of these Terms or for any other reason at its sole discretion. Upon termination, your right to use the Service ceases immediately.

12. Applicable Law and Jurisdiction

These Terms are governed by Moroccan law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Casablanca, Morocco.
